Terms of service, compilation and database rights, privacy policy and accessibility statement.

Terms of service

Effective October 25, 2026

  1. Agreement. These Terms govern access to and use of www.virtualtourguides.co (the “Site”) and the 360° imaging and virtual tour services (the “Services”) of VirtualTourGuides.co, Pawleys Island, South Carolina (“Company”, “we”, “us”). By accessing the Site or engaging the Services, you (“you” or, where you engage the Services, “Client”) accept these Terms. If you do not accept them, do not use the Site or Services.
  2. Definitions. “Content” means all imagery, panoramas, image tiles, previews, text, graphics, code, structured data and other material on or delivered through the Site. “Deliverables” means the tours, images and links produced for a Client under an engagement. “Compilation” has the meaning given in the Compilation & Database Rights section below.
  3. Engagements. Each engagement is governed by the quote, invoice or written correspondence that sets out its scope, fees and schedule (an “Order”), together with these Terms. If an Order conflicts with these Terms, the Order controls for that engagement. A discovery call creates no obligation on either party.
  4. Client obligations. Client represents and warrants that it owns, or has the owner’s authority to permit photography of, each property it presents; that the property will be accessible and prepared at the scheduled time; and that it has removed or secured any person, document, image or item it does not wish captured. Company is not responsible for the capture of items Client fails to remove, though it will make reasonable retouching efforts on request.
  5. Fees. Fees and payment terms are as stated in the Order. Company may withhold delivery or publication of Deliverables until fees are paid in full.
  6. Ownership and license. Company owns all right, title and interest, including copyright, in the Content and Deliverables. Upon payment in full, Company grants Client a non-exclusive, non-transferable, perpetual license to display and distribute the Deliverables solely to market the property or business photographed, including on listing services, the MLS, Zillow, Google Maps and Search, Client’s websites and social media, and Client’s advertising. Client may not sublicense, sell or otherwise make the Deliverables available for use by third parties except as needed for those purposes. Client retains its rights in logos, floor plans and other materials it supplies, and grants Company a license to use them to perform the Services.
  7. Portfolio use. Company may display Deliverables in its portfolio and marketing unless Client opts out in writing. Company will not publish the street address of a private residence without Client’s consent.
  8. Third-party platforms. Deliverables published to Google Maps, Zillow or other platforms are also subject to those platforms’ terms. Company does not control, and is not responsible for, whether, when or how a platform displays, modifies or removes Deliverables.
  9. Acceptable use. You shall not (a) copy, download, frame, republish or create derivative works of the Content except as permitted by these Terms or by law; (b) breach the Compilation & Database Rights section; (c) interfere with or circumvent the security or operation of the Site; or (d) use the Site unlawfully.
  10. Disclaimer. The Site, Content and Services are provided “as is” and “as available”. To the fullest extent permitted by law, Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Company does not warrant any outcome from the Services, including sale price or speed, bookings, traffic or search ranking. Statistics on the Site are attributed to third-party sources and are not Company representations.
  11. Limitation of liability. To the fullest extent permitted by law, Company shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and Company’s aggregate liability arising out of or relating to an engagement shall not exceed the fees paid by Client for that engagement, or, for use of the Site alone, one hundred U.S. dollars (US$100).
  12. Indemnity. Client shall indemnify and hold Company harmless from claims arising from Client’s breach of Clause 4 or from materials Client supplies.
  13. Governing law and venue. These Terms are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules. The state and federal courts located in South Carolina have exclusive jurisdiction, and each party submits to their jurisdiction.
  14. General. If any provision is held unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. Company may amend these Terms by posting a revised version with a new effective date; amendments do not apply to an Order accepted before that date.

Compilation & database rights

Effective October 25, 2026

  1. The Compilation. The Site and the Content constitute a compilation and database (the “Compilation”) created through Company’s substantial investment in obtaining, verifying and presenting its contents. The Compilation includes, without limitation: (a) the panoramic photographs, image tiles and previews; (b) each tour’s structure, including scene selection and sequencing, node positions, link and hotspot coordinates, headings, orientations and floor maps; (c) titles, captions, descriptions and metadata; and (d) the structured data published with the Site.
  2. Rights reserved. Company owns and reserves (a) copyright in the original Content and in the selection, coordination and arrangement of the Compilation, including under 17 U.S.C. §§ 101 and 103; and (b) to the extent applicable to you, the sui generis database right under Directive 96/9/EC and the corresponding laws of the United Kingdom and other jurisdictions. Nothing here claims rights in underlying facts or public-domain material as such.
  3. Prohibited extraction. Except as permitted in Clause 5, and without Company’s prior written consent, you shall not, whether manually or by automated means: (a) extract or re-utilize all or a substantial part of the Compilation, or repeatedly and systematically extract or re-utilize insubstantial parts of it; (b) scrape, crawl, harvest or bulk-download the Content, image tiles or tour data; (c) use the Compilation, or any part of it, for text and data mining; (d) use it to train, fine-tune or otherwise develop any machine learning or artificial intelligence model, or retain it in any training dataset; or (e) compile, publish or distribute any dataset, index or derivative database built from it.
  4. Text and data mining reservation. Company expressly reserves the Compilation from text and data mining, including under Article 4(3) of Directive (EU) 2019/790. This reservation is also expressed in machine-readable form on the Site, and applies whether or not a particular agent reads it. It does not restrict the uses permitted in Clause 5.
  5. Permitted uses. (a) Search engines may crawl and index the Site and display titles, snippets, thumbnails and link previews in search results and social shares. (b) AI search and answer services may access the Site to retrieve, summarize and quote reasonable excerpts in response to user queries, provided the response attributes and links to the Site and the Content is not used for any purpose prohibited by Clause 3(d). (c) Individuals may view the Site and share links to it.
  6. Client Deliverables. A Client’s license under the Terms of Service extends to that Client’s own Deliverables only. It confers no right in the Compilation as a whole, in its structure, or in any other client’s tours.
  7. Licensing. Requests to license the Compilation or any part of it may be sent to timothy@virtualtourguides.co.

Accessibility statement

Effective October 25, 2026

  1. Commitment. Company aims for the Site to conform to the Web Content Accessibility Guidelines (WCAG) 2.2, Level AA.
  2. Measures. Text and controls meet AA color contrast; all pages are operable by keyboard with visible focus; headings, landmarks and labels support screen readers; images carry text alternatives and decorative graphics are hidden from assistive technology; and pages reflow on small screens and at 200% zoom.
  3. Known limitations. The 360° tour viewer is inherently visual and may be difficult to operate with a screen reader or keyboard alone; each sample tour is accompanied by a written title, location and description. Booking is provided through Google Calendar, which Company does not control. On request, Company will provide a detailed written description or still photographs of any tour, and will book appointments by telephone, text or email.
